Liability waiver

Acknowledgment of Risks

I acknowledge that participating in charter boat activities, including but not limited to fishing, swimming, snorkeling, and other water-based recreational activities in the waters surrounding St. Croix, U.S. Virgin Islands, involves inherent risks and dangers including but not limited to:

• Slipping, falling, or injury while boarding, disembarking, or moving about the vessel
• Drowning or near-drowning incidents
• Marine life encounters including jellyfish, sea urchins, sharks, or other potentially dangerous creatures
• Sunburn, heat exhaustion, or dehydration
• Equipment malfunction or failure
• Sudden weather changes, rough seas, or adverse ocean conditions
• Collisions with other vessels, submerged objects, or marine hazards
• Cuts, bruises, sprains, or other physical injuries from fishing equipment or boat operations

I understand these risks and voluntarily assume all risks associated with participation in this charter excursion.

Waiver and Release of Liability

In consideration for being permitted to participate in this charter excursion, I hereby release, waive, discharge, and covenant not to sue GoBono Rentals, its owners, operators, captains, crew members, employees, agents, and representatives (collectively "the Company") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or damage to any property belonging to me while participating in this activity or while on the Company's premises, whether caused by the negligence of the Company or otherwise.

Medical Certification

I certify that I am in good physical and mental health and have no medical conditions that would prevent my safe participation in this charter excursion. I agree to disclose any relevant medical conditions, medications, or physical limitations to the captain before departure.

Alcohol and Substance Use

I understand that I must not be under the influence of alcohol or controlled substances when boarding the vessel. I agree that the captain has sole discretion to refuse boarding or terminate the charter if intoxication or substance use is suspected, with no refund provided.

Safety Regulations

I agree to:

• Follow all instructions given by the captain and crew members
• Wear a U.S. Coast Guard-approved personal flotation device (PFD) when required
• Remain seated while the vessel is in motion unless authorized by the captain
• Refrain from reckless behavior that could endanger myself or others
• Notify the crew immediately of any unsafe conditions or medical emergencies

I understand that failure to comply with safety instructions may result in immediate termination of the charter with no refund.

Media Release

I grant permission to the Company to use photographs or video footage taken during this charter for promotional purposes, including but not limited to websites, social media, and marketing materials.

Indemnification

I agree to indemnify and hold harmless the Company from any loss, liability, damage, or costs, including attorney fees, that may arise from my participation in this charter excursion.

Severability

I understand that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

Governing Law

This agreement shall be governed by the laws of the U.S. Virgin Islands, and I consent to the exclusive jurisdiction of the courts of the U.S. Virgin Islands for any disputes arising from this agreement.

Acknowledgment

I have read this waiver and release of liability, fully understand its terms, understand that I am giving up substantial rights including my right to sue, and sign it freely and voluntarily without any inducement.
